Terms of Service

English: By accessing or using AutoPieces Canada ("Platform", "Service", "we", "our"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our Platform.

Français: En accédant ou en utilisant AutoPieces Canada ("Plateforme", "Service", "nous", "notre"), vous acceptez d'être lié par ces Conditions d'utilisation et toutes les lois et règlements applicables. Si vous n'êtes pas d'accord avec une partie de ces conditions, vous ne pouvez pas utiliser notre Plateforme.

2.1 Account Creation / Création de compte

To use certain features of the Platform, you must register for an account. You agree to:

• Provide accurate, current, and complete information / Fournir des informations exactes et complètes
• Maintain and update your information to keep it accurate / Maintenir vos informations à jour
• Keep your password secure and confidential / Garder votre mot de passe sécurisé
• Notify us immediately of any unauthorized access / Nous notifier de tout accès non autorisé
• Be at least 18 years old / Avoir au moins 18 ans

2.2 Account Responsibility / Responsabilité du compte

You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from unauthorized use of your account.

Vous êtes responsable de toutes les activités qui se produisent sous votre compte.

2.3 Account Termination / Résiliation du compte

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, illegal, or harmful activities.

3.1 Sellers / Vendeurs

You may NOT sell / Vous ne pouvez PAS vendre:

• ❌ Stolen, counterfeit, or illegal auto parts / Pièces volées, contrefaites ou illégales
• ❌ Safety-critical parts that don't meet Canadian Motor Vehicle Safety Standards (CMVSS)
• ❌ Parts with tampered VINs or serial numbers / Pièces avec numéros de série altérés
• ❌ Recalled or defective parts without disclosure / Pièces rappelées sans divulgation
• ❌ Airbags or safety restraints (unless new and certified)

You MUST / Vous DEVEZ:

• ✅ Provide accurate descriptions and photos / Fournir des descriptions exactes
• ✅ Disclose any defects, damage, or issues / Divulguer tout défaut ou dommage
• ✅ Honor your listed price and availability / Respecter votre prix affiché
• ✅ Ship items within 3 business days of payment / Expédier sous 3 jours ouvrables
• ✅ Package items securely to prevent damage / Emballer les articles de manière sécurisée
• ✅ Provide tracking information / Fournir les informations de suivi

3.2 Buyers / Acheteurs

You agree to / Vous acceptez de:

• ✅ Complete payment for purchased items / Compléter le paiement des articles achetés
• ✅ Inspect items upon delivery / Inspecter les articles à la livraison
• ✅ Report issues within 7 days / Signaler les problèmes sous 7 jours
• ✅ Communicate professionally with sellers / Communiquer professionnellement
• ✅ Not abuse the dispute resolution system / Ne pas abuser du système de litiges

3.3 Communication / Communication

All transactions must be completed through the Platform. Direct exchanges of contact information or off-platform transactions are strictly prohibited and may result in account termination.

Toutes les transactions doivent être complétées via la Plateforme. Les échanges hors plateforme sont strictement interdits.

4.1 Payment Processing / Traitement des paiements

All payments are processed securely through Stripe, our PCI-DSS Level 1 compliant payment processor. We do not store your full credit card information.

4.2 Platform Fees / Frais de plateforme

4.3 Escrow and Payouts / Séquestre et paiements

When a buyer purchases an item, the payment is held in escrow until:

• The buyer confirms receipt and satisfaction with the item, OR
• 14 days have passed since delivery confirmation (automatic release)

Sellers receive payouts within 2-5 business days after release.

4.4 Refunds / Remboursements

Refunds are issued according to our dispute resolution process. Stripe processing fees are non-refundable.

You may NOT:

English: The Platform and its original content, features, and functionality are owned by AutoPieces Canada and are protected by international copyright, trademark, and other intellectual property laws.

Français: La Plateforme et son contenu original sont la propriété d'AutoPieces Canada et sont protégés par les lois internationales sur le droit d'auteur.

User Content: By posting content (listings, photos, messages), you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content on the Platform.

We are NOT responsible for:

• The quality, safety, legality, or accuracy of listings
• The conduct of buyers or sellers
• Disputes between users
• Shipping delays or lost packages (seller responsibility)
• Compatibility or fitness of parts for specific vehicles

Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, OR $100 CAD, WHICHEVER IS GREATER.

If you have a dispute with another user, you should first attempt to resolve it directly through our messaging system. If unsuccessful, you may open a formal dispute through the Platform.

Our Dispute Process:

1. Buyer opens dispute within 14 days of delivery
2. Buyer provides evidence (photos, description)
3. Seller has 48 hours to respond
4. Our team reviews all evidence
5. Decision made within 5 business days
6. Funds released to appropriate party

Arbitration / Arbitrage

Any disputes that cannot be resolved through our process shall be settled by binding arbitration in accordance with the laws of Ontario, Canada.

English: These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Français: Ces Conditions sont régies par les lois de la province de l'Ontario et les lois fédérales du Canada applicables.

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email and/or a prominent notice on the Platform at least 30 days before the changes take effect.

Nous nous réservons le droit de modifier ces Conditions à tout moment avec un préavis de 30 jours.

Continued use of the Platform after changes constitutes acceptance of the new Terms.
